CM-3174-C-2024 This is an application under Section 151 CPC for withdrawal of the main Regular Second Appeal.
Learned counsel for the applicant-appellants submits that the appellants were defendants in the suit, which was decreed on 04.02.2014 against them and their appeal before the first Appellate Court was dismissed on 15.03.2016. During the pendency of the present Regular Second Appeal, wherein the aforesaid judgments and decree passed by both the Courts below have been challenged, applicant-appellants have settled the matter with the plaintiff and in view of the same, they do not want to continue with the present appeal. The application is supported by respective affidavits of both the appellants.
In view of the above, the present application deserves to be accepted.
