1. The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of Certiorari/Mandamus or such other appropriate writ, order or directions quashing the action of the respondents in not releasing the Family Pension and Death-cum-Retirement Gratuity to the petitioner in respect of service rendered by her deceased husband.

2. Learned counsel for the petitioner submits that the husband of the petitioner died on 08.09.2020 and till date, the family pension and gratuity has not been released and in the written statement the solitary reason for the same that has given of that the status report of the vigilance case against husband, is awaited. He submits that a direction be given for deciding the claim of the petitioner in a time bound manner and even consider the grant of interest thereon, in terms of judgment in the case of A.S.Randhawa vs. State of Punjab and others, 1997 (3) SCT 468.

3. In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the claim of the petitioner including that of interest, if any, within a period of 3 months and in case found entitled, release the same forthwith.
