1. This is a Civil Writ Petition filed under Article 226 of the Constitution of India for the issuance of a writ in the nature of certiorari for quashing/revising the impugned final result dated 04.03.2019 (Annexure P-

11) to the extent that the non-deserving candidates have been selected and recruited by the respondents by granting five marks as prescribed under socio-economic criteria as per advertisement and revising to the extent to grant five marks to the petitioner as per advertisement and thereby including him in the list of selected candidates. Challenge is also to the order dated 27.10.2023 (Annexure P-15).

A perusal of order dated 27.10.2023 (Annexure P-15) would show that the judgment of the Single Bench relied upon by the petitioner i.e. 1 of 2 ::: Downloaded on - 22-03-2024 05:43:43 ::: Neutral Citation No:=2024:PHHC:041076 CWP-6830-2024 [2] 2024:PHHC:041076 CWP-11590-2019 titled as Sombir Vs. State of Haryana and another decided on 16.05.2023 has been stayed by the LPA Bench in LPA No.1169 of 2023 vide order dated 24.08.2023. In the impugned order dated 27.10.2023, it has been mentioned that in view of the said pendency of LPA and stay granted, the case of the petitioner cannot be considered at this stage.

3. Learned counsel for the petitioner has submitted that in view of the same, he be permitted to withdraw the present writ petition at this stage with liberty to the petitioner to file petition on the same cause of action after the decision of the abovesaid LPA.

4. In view of the above, the present Civil Writ Petition is dismissed as withdrawn with liberty aforesaid.
