1. A suit was filed by the plaintiff for permanent injunction restraining the defendants from interfering in the possession of Thara or vacant site in front of House No.119/11-1. The said suit was dismissed and the appeal filed by the plaintiffs against the said judgment was decreed. Challenging the said judgment of the appellate Court, the present Regular Second Appeal has been filed.
2. Although, as per the report of the registry, counsel for the appellant has been informed but none has appeared on behalf of the appellant.
3. Dismissed for non-prosecution. Liberty is granted to the LRs of the appellant to move an application for revival of the present appeal, in case, any cause of action survives in the same.
