1. By way of instant petition filed under Section 11 (6) of the Arbitration and Conciliation Act, 1996, petitioner has approached this Court for appointment of an Arbitrator.
2. When confronted with the judgment of the Supreme Court in Indian Oil Corporation Limited Versus NCC Limited (2023) 2 SCC 539, counsel for the petitioner has sought permission to withdraw the petition with liberty to take recourse to the remedy available to him in accordance with law.
3. Dismissed as withdrawn with aforesaid liberty.
