1. The present petition has been filed under Section 438 Cr.P.C. seeking grant of anticipatory bail in case FIR No.0002 dated 03.01.2024, under Sections 148, 149, 323, 506 of IPC (Sections 308 and 326 of IPC added during investigation), registered at Police Station Rai, District Sonipat.

2. Learned counsel for the petitioner submits that, in fact, the son of the petitioner had suffered injuries and he had immediately informed the matter to the SHO, Rai, District Sonipat on 03.01.2024 and also to DSP, Sonipat on 10.01.2024 through registered letter and email. However, the authorities did not take any action and only in February 2024, the complaint was filed.

However, learned State counsel vehemently opposes the grant of any concession to the petitioner as there is a specific allegation Manju 2024.03.23 10:13 I attest to the accuracy and integrity of this document 2024:PHHC:039869 CRM-M-14404-2024 -2- against the petitioner that he had inflicted injury on the head of the victim with an iron rod and, hence Section 308 of IPC had been invoked.

4. After hearing learned counsel for the parties and in light of the judgment passed by the Hon'ble Supreme Court of India in CBI Vs. Anil Sharma(1997) 7 SCC 187, this Court does not find any ground to grant of extraordinary concession of anticipatory bail to the petitioner, at this stage, as the weapon used in the crime is yet to be recovered and the investigation is still at an initial stage.

5. Accordingly, the present petition stands dismissed.
