1. Learned counsel for the petitioners states that he does not wish to press the present petition on merits. He, however, prays that the appeal, which is pending for the last 6 years, may be ordered to be decided expeditiously.

2. Learned counsel for the respondent-caveator states that he has no objection if the appeal, which is pending for the last 6 years, is directed to be heard and decided expeditiously.

3. Heard.

4. In the present case there have been two round of litigation upto this Court. The appeal has been pending for the last 6 years and is ripe for arguments. Both the counsel have assured this Court that they would not seek any further adjournment in the matter. Further, learned counsel for the petitioners has stated that he is even ready to argue the appeal on the next date of hearing itself fixed before the First Appellate Court. Learned counsel AMAN JAIN 2024.03.19 21:05 I attest to the accuracy and integrity of this judgment/order.

132 CR-1690-2024 (O&M) -2- for the respondent-caveator has stated that he would file an application for preponing of the case before the First Appellate Court, if necessary.

5. In view of the above, the First Appellate Court is requested to hear and decide the appeal expeditiously and preferably before the next date of hearing fixed before the Executing Court i.e. 15.04.2024, in accordance with the law. Both the parties shall not seek any further adjournment in the matter on any account as assured by their respective counsel.

6. The present revision petition stands disposed off in the above terms. Pending applications, if any, also stand disposed off.
