1. Learned counsel for the appellant submits that keeping in view the directions given by the lower Appellate Court for promotion, the respondents were under an obligation to grant the appellant promotion to the next higher rank from the date his junior was promoted.

2. Learned State counsel submits that paragraph 10 of the judgment of the lower Appellate Court has already been complied with and the claim of the appellant for the grant of promotion has already been accepted and appropriate orders granting promotion were passed on 22.10.2001 and thereafter his pay has also been re-fixed which clearly shows that the benefit of promotion has already been granted to the appellant.

3. Learned counsel for the appellant submits that keeping in view the above, the present appeal may kindly be disposed of having been not pressed any further but liberty be given to the appellant that in case, he thinks that he was also entitled for the arrears of salary upon retrospective promotion, he can avail appropriate remedy.

4. Ordered accordingly.

5. Any civil miscellaneous application pending if any, also stands disposed of.
