1. The appellant has filed the instant appeal against judgment and decree dated 15.09.1992, whereby learned Additional District Judge, Patiala, while allowing the appeal filed by the respondent/defendant has set aside the judgment and decree dated 07.05.1990 passed by learned Senior Sub Judge, Patiala, whereby a suit filed by the appellant/plaintiff has been decreed in his favour.
2. On the last date of hearing, the following order was passed :-
"Mr. Nikhil Vats, Advocate, has appeared and filed his vakalatnama on behalf of the respondent, which is taken on record.
Learned counsel for the appellant submits that during the pendency of the appeal, appellant has died on 17.08.2005 and he seeks time to implead LRs of the appellant and to get instructions as to whether anything survives in the present appeal or not.

3. Learned counsel for the appellant pleads no instructions.
4. Perusal of the file further shows that no legal representatives have been brought on record.
5. In view of the above, the present appeal is dismissed for non-prosecution with liberty to the legal representative of the appellant to revive the same, if any cause of action still survive.
