CORAM: HON'BLE MR. JUSTICE ANIL KSHETARPAL

Present:- Mr. Bhupinder Banga, Advocate for the petitioner

ANIL KSHETARPAL, J (Oral)

This revision petition is being taken up at 4:25 pm. Learned counsel representing the petitioner expresses urgency. He submits that the Executing Court has dismissed the petitioner's objection petition and issued warrants of possession, though the petitioner's first appeal against the judgment and decree for the mandatory injunction is pending. He has submitted that the First Appellate Court has not decided the application for grant of stay, however, adjourned the hearing of the appeal to 09.07.2024. She has also filed an application for grant of interim relief, which is yet to come up for hearing.

Keeping in view the aforesaid facts and circumstances of the case, it is considered appropriate to direct the First Appellate Court to decide the petitioner's prayer for grant of interim order, within a period of 15 days, from today. Till then, there shall be stay on the implementation of the decree, however, the First Appellate Court will decide the prayer for stay independently uninfluenced by the order passed by this Court.
