1. The appellant has filed the instant appeal against judgment and decree dated 28.02.1996 passed by learned Civil Judge (Junior Division), Hisar, whereby suit for recovery filed by the appellant/plaintiff has been dismissed as well as judgment and decree dated 21.12.1996 passed by learned Additional District Judge, Hisar, whereby an appeal filed by the appellant/plaintiff against judgment and decree dated 28.02.1996 has been dismissed.
2. Learned counsel for the sole appellant pleads no instructions.
3. As per the office report, notice issued to the appellant has been received back unserved with the report "he has already retired from service on attaining the age of superannuation on 31.08.2005".
4. In view of the above, the present petition is dismissed for non-prosecution. However, liberty is granted to the appellant to revive the present appeal, if anything still survives.
