1. Petitioner (Avtar Singh) has filed the present petition under Section 482 of the Code of Criminal Procedure inter alia seeking quashing of Complaint No.RBT-111-COMI of 2017 (Annexure P-1) and subsequent proceedings, i.e. summoning order, framing of charge etc. and judgment of conviction dated 15.06.2018 (Annexure P-2) passed by the Court of learned Additional Chief Judicial Magistrate, Fatehabad on the basis of compromise dated 05.09.2023 (Annexure P-3) arrived at between the parties.

2. Learned counsel for the petitioner, at the outset, submits that respondent No.2/complainant (Ms. Piar Kaur @ Puro @ Jangir Kaur) has unfortunately expired, and accordingly, he prays for withdrawal of the instant petition with liberty to file fresh one by impleading the legal representatives of deceased-respondent No.2/complainant.

3. Keeping in view the aforesaid submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the liberty aforesaid.
