1. Petitioner (Major Singh) has filed the present petition under Section 439 of the Code of Criminal Procedure seeking grant of regular bail in case bearing FIR No.39 dated 30.01.2022 (Annexure P-1), under Section 379-B (2) read with Section 34 of the Indian Penal Code (Section 411 of the Indian Penal Code, added later on), registered at Police Station Maqboolpura, District Police Commissionerate Amritsar.

2. Reply by way of affidavit dated 13.03.2024 of Mr. Gurinderbir Singh, P.P.S., Assistant Commissioner of Police, East, Amritsar City is filed on behalf of State of Punjab in Court today, which is taken on record, subject to all just exceptions.

3. Learned State counsel, while referring to paragraph No.11 of the aforesaid reply dated 13.03.2024, submits that the present petition is 1 of 2 ::: Downloaded on - 16-03-2024 09:31:01 ::: Neutral Citation No:=2024:PHHC:037963 CRM-M-22344-2023 -2- rendered infructuous as the trial in this case already stands concluded and petitioner (Major Singh), along with co-accused Hardavinder Singh, has been acquitted by the trial Court vide judgment dated 20.12.2023; which fact is also corroborated by learned counsel for the petitioner.

4. Keeping in view the aforesaid submissions made by learned counsel for the parties, the present petition is dismissed as infructuous.

5. All pending application(s), if any, shall also stand closed.
