1. The present petition is for grant of anticipatory bail to the petitioners in FIR No.113 dated 28.10.2023, under Sections 458, 323, 341, 506 and 149 of IPC, registered at Police Station Sadar Ahmedgarh, District Malerkotla.
2. Vide order dated 18.01.2024, a Coordinate Bench of this Court while granting the concession of interim anticipatory bail directed the petitioners to join investigation.
3. Learned State counsel, on instructions from ASI Gurmail Singh, submits that the petitioners have joined the investigation and their custodial interrogation is no longer required.
4. In view of above, the petition is allowed. The order dated 18.01.2024 granting interim anticipatory bail to the petitioners, is made | attest to the accuracy and integrity of this Order/Judgment SANDEEP SETHI 2024.03.19 00:26 2024:PHHC:035425 CRM-M-61552-2023 (O&M) absolute. However, the petitioners shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
5. However, nothing stated above shall be construed as a final expression of opinion on the merits of the case and this order shall not be considered as parity qua any other co-accused.
6. It is made clear that, in case, the petitioners are found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
7. Pending miscellaneous application shall also stand disposed of. (ALOK JAIN) JUDGE March 12, 2024.
