1. The present petition is for grant of anticipatory bail to the petitioner in case FIR No.0105 dated 09.12.2023 under Sections 21 (1) of the Mines and Minerals (Development and Regulation) Act, 1957, Section 19 of the Punjab Land and Preservation Act, 1900, Section 51 of the Indian Forest Act, 1927 and Section 3-A of the Forest (Conservation) Act, 1980, registered at Police Station Kiratpur Sahib, District Rupnagar.
2. Vide order dated 30.01.2024, this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation.
3. Learned State counsel, on instructions from ASI Pritam Singh, submits that the petitioner has joined the investigation and his custodial | attest to the accuracy and integrity of this Order/Judgment SANDEEP SETHI 2024.03.16 00:07 2024:PHHC:035421 CRM-M-2626-2024 (O&M) interrogation is no longer required.
4. In view of above, the petition is allowed. The order dated 30.01.2024 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
5. However, nothing stated above shall be construed as a final expression of opinion on the merits of the case and this order shall not be considered as parity qua any other co-accused.
6. It is made clear that, in case, the petitioner is found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
7. Pending miscellaneous application(s) shall also stand disposed of.
