This is an appeal against the impugned judgment of conviction dated 21.02.2024, whereby the appellant has been convicted under Section 20 of NDPS Act, 1985 and vide impugned order dated 22.02.2024, the appellant has been sentenced to undergo rigorous imprisonment for a period of two years and to pay a fine of Rs.20,000/- and in default of payment of fine, to further undergo simple imprisonment for a period of three months.
Learned counsel for the petitioner submits that he filed the instant petition under the instructions of his client but later on came to know that another appeal has also been filed by the appellant through Mr. Randeep Singh Dhull, Advocate and hence, prays for withdrawal of the instant petition.
Prayer is accepted.
Considering the genuineness and bona fide error on the part of the appellant, the appeal is ordered to be withdrawn with liberty that another 1 of 2 ::: Downloaded on - 14-03-2024 04:05:41 ::: Neutral Citation No:=2024:PHHC:034937 CRA-S-996-2024 (O&M) -2- appeal bearing CRA-S-995-2024 titled as "Dharambir versus State of Haryana", is to be entertained as the only appeal being filed by the present appellant.
