1. In the present writ petition, the grievance of the petitioner is that the petitioner, who was working as a Craft Teacher in the Panchayat Samiti of Block Dadri-II, has not been given her pensionary benefits, which is totally arbitrary and illegal.
2. Learned senior counsel for the petitioner submits that a similarly situated Craft Teacher working in the Panchayat Samiti of Block Dadri-II has already been allowed the pensionary benefits and relies upon the judgment of the Coordinate Bench of this Court in CWP No.7778 of 2013 titled as Hanuman vs. State of Haryana and others, decided on 16.01.2020 to claim the same benefit.

Learned senior counsel for the petitioner submits that the grievance raised in the present writ petition has already been raised by the 1 of 2 ::: Downloaded on - 16-03-2024 07:14:50 ::: Neutral Citation No:=2024:PHHC:033969 CWP-5649-2024 2024:PHHC:033969 2 petitioner through a final demand/legal notice dated 15.12.2023 (Annexure P-7) which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage in case a time bound direction is issued to the respondents to decide the said notice by passing an appropriate speaking order.

5. Mr. Harish Nain, learned Assistant Advocate General, Haryana, accepts notice on behalf of the respondents.

Learned counsel for the respondents submits that in case, the demand/legal notice dated 15.12.2023 (Annexure P-7) has been received in the concerned office and is still pending consideration, the same will be decided by the authorities concerned within a period of eight weeks of the receipt of copy of this order and in case, after the decision of the legal notice, any benefit accrues to the petitioner, the same will also be released to her within a further period of four weeks otherwise, due reasons be mentioned in the speaking order for not accepting the prayer of the petitioner for her information and necessary action.
7. Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present writ petition may kindly be disposed of having been not pressed any further.
