TRIBHUVAN DAHIYA, J. (ORAL)

This petition has been filed inter alia seeking a direction to the respondents to allow the petitioners to join the post of Para-Teaching Associate (TGT Sanskrit/Hindi) on the basis of deployment offer letters, dated 30.11.2022, Annexure P-5.

2. Learned counsel for the petitioners contends that despite the deployment offer, the Department has not permitted the petitioners to join the post on account of changed criteria of eligibility. Since the criteria had been changed after deployment orders were issued, it would not have any application on the petitioners' case in terms of the law laid down by this Court, vide judgment dated 13.03.2023, rendered in CWP No.29118 of 2022 titled Sumitra Devi and others v. State of Haryana and others. He further contends that at this stage, the petitioners will be satisfied in case the fourth respondent is directed to consider and decide the petitioners' representations, dated 03.12.2022 and 15.12.2022, Annexure P-9 and P-10 respectively, in the light of law laid down in Sumitra Devi case (supra).

MANINDER 2024.03.14 10:11 I attest to the accuracy and authenticity of this order/judgment.

CWP-11656-2023 2 2024: PHHC:034646

3. Learned State counsel does not object to the same and contends that the petitioners' representations, dated 03.12.2022 and 15.12.2022, will be decided by respondent no.4-Director, Elementary Education, by passing a speaking order in accordance with law, in the light of the judgment in Sumitra Devi case (supra) within a period of six weeks.

4. In view of the statement made by learned State counsel, learned counsel for the petitioners has no objection to the petition being disposed of in terms thereof.

5. Ordered accordingly.
