1. In the present appeal, the challenge is to the judgment and decree of the Lower Appellate Court dated 21.03.1997, by which, the suit filed by the respondent/plaintiff for confirming him as an Assistant w.e.f. 27.11.1979 has been allowed.
2. It may be noticed that there is no interim order in the favour of the appellant and the judgment and decree of the Lower Appellate Court must have been complied with and the respondent must have retired by now. Keeping in view the said factual position, no useful purpose will be achieved in unsettling the settled things and that too qua a retired employee who has retired approximately two decades ago.
3. Even otherwise, in the RSA only the perversity in the judgment of the Courts below could be appreciated and not the re-arguing of the issue in hand so as to re-appreciate the evidence.

4. Keeping in view the above fact as well as that no perversity has been pointed out in the judgment of the Lower Appellate Court, no ground is made out for any interference.
5. The regular second appeal stands dismissed.
