1. In the present writ petition, the grievance of the petitioner is that the daily wage service rendered by the petitioner from 08.01.1982 to 31.01.1996 has not been treated as qualifying service for computing the pensionary benefit which is totally arbitrary and contrary to the full bench judgment of this Court in 'K Kesar Chand Vs. State of Punjab and others', AIR 1988 Punjab and Haryana 265.

2. Learned counsel for the petitioner submits that the grievance raised in the present writ petition has already been raised by the petitioner through a legal notice dated 03.10.2023 (Annexure P-3) and the petitioner will be satisfied at this stage in case a time bound direction is issued to the respondents to decide the said legal notice by passing an appropriate speaking order.

4. Mr. Harish Nain, learned Assistant Advocate General, Haryana, who is present in the Court, accepts notice on behalf of the respondents.

Learned counsel for the respondents submits that in case the legal notice of the petitioner dated 03.10.2023 (Annexure P-3) has been received with the authorities concerned and the same is still pending consideration, an appropriate speaking order will be passed within a period of eight weeks from the receipt of copy of this order and in case, after the decision, it is found feasible to extend the relief to the petitioner, the same will be extended otherwise, due reasons will be mentioned while passing the speaking order, which will be conveyed to the petitioner for his information and necessary action.

6. Learned counsel for the petitioner submits that keeping in view the statement of learned counsel for the respondents, the present writ petition may kindly be disposed of having been not pressed any further.
