1. The present appeal pertains to the year 1995. On the previous date i.e. 06.05.2024 fresh notice was issued to the appellant returnable today. As per the Office report, notice issued to the appellant has been received back unserved with report that he is not residing at the given address for the last 3-4 years. There is no other address available with the Court for effecting service of the appellant except the one mentioned in the memo of parties and in the judgments and decrees passed by the Courts below and is the same on which the notice was sent.
2. Today learned counsel appearing on behalf of the appellant states that he has not been able to contact the appellant despite his best efforts.

3. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
4. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
