Challenge in the present writ petition is to the judgment and decree dated 05.06.2012 passed by the Civil Judge, (Junior Division), Ludhiana having been allegedly obtained by way of fraud and misrepresentation.
It is fairly conceded by the Counsel appearing on behalf of the petitioner that against the above said judgment and decree, an application under Order 9 Rule 13 for setting aside the ex-parte decree had been preferred and that the said application had also been dismissed. He had not preferred any appeal which is admissible under Order 41 of the Code of Civil Procedure, 1908 against the said order.
