1. The prayer in the present petition is for directing the respondent Nos.1 and 2 to consider the case of the petitioner for promotion as Industrial Extension Officer (IEO) in the Field Cadre (Industrial Extension Officer) from the date her junior respondent No.3 was promoted, vide order dated 25.01.2017.
2. Learned counsel submits that the petitioner, working as Steno- Typist, was on request transferred to the Field Officer Cadre, due to which was placed at the bottom of the seniority list i.e. serial No.63, while respondent No.3, who also on request, subsequently joined the same cadre, was given seniority at serial No.73. However by relaxing the required experience from 6 years to 4 years, respondent No.2 was promoted on 25.01.2017, Annexure P-7, which at that time, the petitioner did not possess. HAMANT 2024.07.03 17:25 I attest to the accuracy and integrity of this order/judgment CWP-14945-2018 2 He refers to the affidavit dated 09.05.2024 filed pursuant to the direction passed by this Court on 24.04.2024, as per which, the post of Industrial Extension Officer (Field Cadre) is available and prays for her consideration against the same, from the date the petitioner became eligible, i.e. on 22.05.2017 on acquiring 4 years experience as that of respondent No.3.
3. Learned State counsel has no objection to the limited prayer made.
4. In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to consider and decide the claim of the petitioner within a period of 4 months in accordance with law and in case, found eligible and suitable, necessary benefit may be granted.
