This intra Court appeal has been filed challenging decision dated 29.04.2024 passed in CWP-10644-2019. Said writ petition was disposed of vide order dated 29.04.2024, while directing present appellant to pass appropriate order while considering judgment dated 23.01.2024 of this Court in Balbir Kaur Vs. Punjab and Sind Bank and others, CWP- 21313 of 2021.

2. Learned counsel for the appellant vehemently argues that applicable Rules and Regulations in the present case and specifically Regulation No.48 provides that proceedings may not be instituted in respect of 'cause of action' which arose or 'in respect of an event which took place' before four years of the institution of the same. However, provision of institution of proceedings qua arising of 'cause of action' is not present in Regulation No.48 of Punjab and Sind Bank (Employees) Pension Regulations, 1995, which was the relevant provision in case of Balbir Kaur 1 of 2 ::: Downloaded on - 10-08-2024 09:53:24 ::: Neutral Citation No:=2024:PHHC:098845-DB 2024:PHHC:098845-DB LPA-1790-2024 (O&M) -2- (supra) . This aspect has not been discussed in order dated 29.04.2024.

3. At this stage, learned counsel for the appellant seeks permission to withdraw this appeal with liberty to file appropriate application before learned Single Judge for clarification/ review/ modification of order dated 29.04.2024.

4. Appeal is, accordingly, dismissed as withdrawn with liberty as aforesaid.
