Learned counsel for the appellant submits that as per the report, respondent has died hence, the present regular second appeal may kindly be disposed of having been not pressed any further with liberty to revive the same in case any legal heir of the respondent files an execution petition against the judgment and decree of the Court below under challenge in the present appeal, which has been stayed by this Court.
