1. Learned counsel for the petitioners submits that there is an anomaly in the pay scale of Laboratory Technicians (Malaria) and the petitioners are entitled for the said benefit keeping in view the judgment of a Co-ordinate Bench of this Court passed in CWP No. 16100 of 1999 titled as Rajesh Kumar and others Vs. State of Haryana and others, decided on 18.04.2022, a copy of which has been appended as Annexure P-3. Learned counsel for the petitioners further submits that the benefit of the said judgment is not being extended to the petitioners, which action of the respondents is totally arbitrary and illegal.

Learned counsel for the petitioners submits that the petitioners have already raised the said grievance by way of representation dated 13.02.2024 (Annexure P-5) but the same is still 1 of 2 ::: Downloaded on - 03-05-2024 00:23:49 ::: Neutral Citation No:=2024:PHHC:058846 CWP No. 9746 of 2024 2024:PHHC:058846 2 pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner.

On the asking of the Court, Mr. Harish Nain, learned Assistant Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondent-State and submits that in case, the representation dated 13.02.2024 (Annexure P-5) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be decided by the competent authority within a period of eight weeks from the date of the receipt of certified copy of this order by passing an appropriate speaking order. Learned counsel further submits that in case, it is found feasible to accept the claim of the petitioners, the same will be accepted, otherwise due reason will be given for not accepting the claim of the petitioners in the speaking order to be passed.

5. Learned counsel for the petitioners submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further.
