The appellant-defendant is in an appeal against the judgment passed by the Court of Sub Judge, First Class, Mahendergarh in Civil Suit No. 814 of 1987 decided vide judgment and decree dated 26.11.1990 as well as the subsequent dismissal of the appeal by the Additional District Judge, Narnaul in Civil Appeal No. 104 of 1990 vide judgment and decree dated 12.02.1993.
Learned counsel appearing on behalf of the appellant- defendant contends that he has made every effort to contact the client and to complete instructions, however, the response is not forthcoming.
In view of the above, it seems that the appellant has no subsisting interest in the present appeal, the same is accordingly dismissed for non-prosecution.
