This is a contempt petition filed under Section 12 of the Contempt of Courts Act, for initiating contempt proceedings against the respondents for disobedience of judgment and decree dated 04.08.2015 passed in Civil Suit No.1500 of 2013 and judgment and decree dated 11.02.2020 passed by Additional District Judge, Fatehgarh Sahib.
It is not even in dispute that as per the judgment and decree passed by the Courts below, the mutation had duly been entered in favour of the petitioner. Although, learned counsel for the petitioner has submitted that subsequently the respondents have got entered some other mutation entries which have taken away the effect of judgment and decree of Courts below, however, that may be a fresh illegal action on the part of respondents; making them liable for any action as per law, however, that would not be within the purview of the Contempt Court.
In view of the above, the present petition is dismissed. However, the petitioner would be at liberty to avail any other alternate remedy, if he is having any other grievance qua the said property.
Rule discharged.
