1. The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue her passport.

2. An FIR No. 68 dated 30.08.2007, under Sections 302, 34 of IPC came to be registered against the petitioner at Police Station Sehna, District Barnala. She was sentenced to life imprisonment by the trial court. She preferred CRA-D- 918-DB of 2009 before this Court. A Division Bench of this Court vide judgment dated 07.10.2013 acquitted her. She, vide application dated 22.01.2024, applied for issuance of passport, however, till date passport has not been issued to her.

3. Ms. Lovepreet Kaur, Advocate submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391.

4. Notice of motion.

5. Ms. Sehej Sandhawalia, Central Government Counsel for Union of India and Mr. Aman Dhir, DAG, Punjab, who on advance notice are present in Court, accept notice and waive service.

6. Ms. Sehej Sandhawalia, Advocate, submits that petitioner may be directed to appear before passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks.

7. Counsel for the petitioner agrees to the aforesaid arrangement.

8. In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 22.05.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 22.05.2024.
