1. The appellant/defendant has filed the instant appeal against judgment and decree dated 29.09.1995 whereby learned District Judge, Ferozepur while allowing the appeal filed by the respondent/plaintiff has set aside the judgment and decree dated 11.05.1993 passed by learned Sub Judge, IIIrd Class, Ferozepur, whereby suit for declaration filed by the respondent/plaintiff has been dismissed.
2. Learned State counsel on instructions from Sh. Pargat Singh, Block Officer (Forest), Ludhiana, submits that the respondent/plaintiff had already stood retired from service on attaining the age of superannuation on 31.07.1996 and thereafter, he died unfortunately in the month of January, 2016. He further submits that even, the wife of the plaintiff has also died.
3. In this view of the matter, the instant appeal is disposed of as no further orders are called for as LRs of the respondent/plaintiff have not been brought on record. However, liberty is granted to both the parties to revive the present appeal in case any execution is filed by any of the parties.
