1. In the present regular second appeal, the prayer of the appellant is that while awarding the arrears, the total arrears have been awarded to the respondents whereas, the said arrears should have only been restricted for a period of 38 months prior to the filing of the civil suit.

2. Learned counsel for the respondent submits that he has instructions that the order passed by the Courts below be amended that the arrears will be restricted to the period of 38 months prior to the filing of the civil suit.

3. Once, the relief claimed in the present regular second appeal is not being opposed by the learned counsel for the plaintiff-respondent, and is agreeable for the modification in the judgment and decrees of the Courts below, the judgments of the Courts below are modified to the extent of that the arrears admissible to the respondent-plaintiff will be only for a period of 38 months prior to the filing of the civil suit.

4. No other argument has been raised by learned counsel for the parties.

5. Keeping in view the above, the present regular second appeal is disposed of with above terms by modifying the judgments and decrees of the Courts below in the manner stated herein above.
