1. Vide order dated 16.05.2023 notices were issued to the appellants and respondent Nos.1(i) to 1(vi). As per the office report, appellant Nos.1, 2 and 4 are stated to have died. Appellant No.3 refused to accept notice and stated that the matter has been compromised between the parties and he does not want to pursue the case. Respondent Nos.1(i) to 1(vi) also remain unserved as they were not found residing at the given addresses. No one has come forward to get themselves impleaded as legal representatives of appellant Nos.1, 2 and 4 nor any counsel has put in appearance on their behalf. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
2. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
