1. The prayer made in the present petition is for directing the respondents to fix the family pension to the petitioner under Family Pension Scheme and to pay the same alongwith interest.

2. Learned counsel would submit that the husband of the petitioner was retired on 31.12.1993 from the post of Deputy Controller (F&A), Department of Finance and was getting monthly pension of Rs.39660/- for the services rendered by him. He unfortunately passed away on 15.02.2020 due to Cardiac Arrest. The petitioner is entitled to the family pension which has since not been released. In this regard, a representation dated 04.12.2023, Annexure P-6, has been submitted by her, which has yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioner is sanguine of it being considered in a positive manner, in case, a direction is given to the respondents to decide the same in a time bound manner by granting her an opportunity of hearing.

4. At the asking of the Court, Mr. Satnam Preet Singh, DAG, HAMANT Punjab accepts notice on behalf of the respondent-State and has no objection 2024.04.26 18:22 I attest to the accuracy and integrity of this order/judgment CWP-9448-2024 2024:PHHC:057262 2 to the limited prayer made.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the representation dated 04.12.2023, Annexure P-6, within a period of six months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to her and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to her interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
