1. The present petition is for quashing of criminal complaint No.CIS-COMA/41775/2022, under Section 138 of the Negotiable Instruments Act, 1881 titled as M/s AK International Vs. M/s Nihal Travels and others.

2. After vehemently arguing on the merits of the case, learned counsel for the petitioner prays for withdrawal of the present petition and further prays that all the contentions made in the present petition be kept open to be raised at an appropriate stage. He further prays that the petitioner be granted the concession of exemption of personal appearance before the trial Court, however, it is not forthcoming as to whether the petitioner has yet put in appearance before the trial Court or not.

3. In light of the above, the present petition is dismissed as | attest to the accuracy and integrity of this Order/Judgment 2024:PHHC:054630 CRM-M-20022-2024 withdrawn without expressing any opinion on the merits and in case the petitioner applies for exemption of personal appearance on any date, the same shall be considered leniently, in accordance with law.

4. It is made clear that this order shall not be construed as permanent exemption from personal appearance.
