The petition has been filed, inter alia, for setting aside the order, dated 01.04.2024, Annexure P-16, whereby the petitioner's service as Extension Lecturer in Geography, has been discontinued due to failure to establish the validity of degree in M.A. (Geography) from Distance Education Department of the Eastern Institute for Integrated Learning in Management University, Sikkim, (in short 'EIILM University') completed in June 2012, as the University was not authorised to award the same for the session 2010-12.

2. The impugned action has been taken by the Department relying upon a judgment rendered by the High Court of Sikkim in W.P.(C) No.56 of 2018 titled Jyoti Aggarwal V s. State of Sikkim and others, holding that EIILM University was not authorised to impart distance education during the session 2010-12, and was allowed to run a few distance education programmes only for the year 2009-10, that too not for M.A. (Geography). 3. Accordingly, he is not qualified to be engaged as an Extension Lecturer and no exception can be taken to the impugned order relieving him from service on that account. However, in case the petitioner is able to get the requisite document or instructions establishing that the degree in M.A. (Geography) awarded to him by the EIILM University is valid, he will be entitled to be engaged as Extension Lecturer in the College.

4. Disposed of with the aforesaid observations.
