1. Present regular second appeal has been filed challenging the judgment and decree of the Courts below by which, the civil suit filed by the appellant-Corporation has been dismissed by the trial Court vide judgment and decree dated 28.02.2014, which judgment has also been upheld by the lower Appellate Court vide judgment and decree dated 13.02.2017.
2. After arguing for some time and apprehending that this Court is not inclined to grant the relief, learned counsel for the appellant-Corporation submits that keeping in view the instruction received from Mr. Charanjeev, Legal Department of appellant-Corporation, the appellant-Corporation will like to settle the issue with the respondents so as to not press the present 1 of 2 ::: Downloaded on - 26-04-2024 00:03:25 ::: Neutral Citation No:=2024:PHHC:054858 RSA-539-2018 (O&M) -2- 2024:PHHC:054858 appeal any further so as to get the Court fee refunded.
3. Learned counsel for the respondents submits that respondents do not have any objection in settling the issue in case, the appeal is not pressed any further.
4. Learned counsel for the appellant-Corporation submits that keeping in view the settlement between the parties, present regular second appeal may kindly be disposed of having been not pressed any further and the Court fee deposited may kindly be directed to be refunded.
5. Keeping in view the above, as the parties have already settled their dispute so as to not press the present appeal any further, present regular second appeal is disposed of having been not pressed any further.
6. As the parties have already settled their issue and the appeal has been disposed of having been not pressed any further, keeping in view the Section 16 of the Court Fee Act, 1870, the Court fee appended along with the present appeal, amounting to Rs.400086.95/- be refunded back to the appellant-Corporation. Registrar of this Court is directed that in case, any such application is made, Court fee appended with the present appeal be refunded back to the appellant-Corporation.
