1. The instant appeal was admitted on 20.01.2000 and thereafter, the operation of the impugned judgment passed by the lower Appellate Court was stayed on 25.08.1999. The said order was modified to the extent that the gratuity, which was withheld due to punishment order passed by the Disciplinary Authority, shall be released to the respondent on his furnishing bank guarantee to the extent of gratuity amount, vide order dated 08.11.2000 passed in CM No. 482 of 2000 in RSA No.2199 of 1998.
2. Learned State counsel on instructions from Sh. Sanjay Narang, Inspector, Food Supply, submits that during the pendency of the present appeal, the respondent has unfortunately died on 21.11.2011.
3. Perusal of the case file shows that the LRs of the deceased-sole respondent have not been brought on record.
4. In view of the above, learned State counsel does not press the present appeal. However, he submits that liberty may be granted to the State for revival of the instant appeal in case, any execution is preferred by the LRs of the deceased-respondent/plaintiff.
5. Disposed of with liberty aforesaid.
