The appellant-defendant is in appeal against the judgment and decree dated 09.12.1989 passed by the then Addl. Sr. Sub Judge, Pathankot in Civil Suit No.225 of 1986 as well as against the judgment and decree dated 19.05.1993 passed by the then Additional District Judge, Gurdaspur in Civil Appeal No.10/17 of 1990/93, whereby the appeal against the judgment and decree dated 09.12.1989, mentioned above, has been dismissed.
Learned counsel appearing on behalf of the respondent Bank informs that during the pendency of the present appeal, the matter has already been settled between the parties and a compromise was arrived at between them on 05.10.2005, pursuant whereto, the decreetal amount was deposited by the appellant-defendant on 31.05.2005 and the Execution proceedings had thereafter been withdrawn as fully satisfied on 12.11.2005.
