The appellants-defendants No.1 and 2 (as mentioned in judgment dated 21.11.1985) are in second appeal against the judgment dated 21.11.1985 passed by the then Sub Judge, First Class, Jalandhar in Civil Suit No. 232 of 1984 dated 01.11.1983, as well as against the judgment dated 08.05.1991 passed by the then Additional District Judge, Jalandhar in Civil Appeal No. 51 of 1991 dated 26.02.1986 whereby the above mentioned judgment dated 21.05.1985 has been affirmed, while dismissing the appeal.

Since there was no representation on behalf of the appellants in the present case, Registry was directed to issue separate notices to the appellants as well as to the counsel representing the appellants.

In response thereto, a report has been furnished by the Registry that the notices issued to the appellants have been received 1 of 2 ::: Downloaded on - 20-04-2024 19:37:28 ::: Neutral Citation No:=2024:PHHC:052864 RSA-1908-1991 (O&M) -2- back with a report "not residing at the given address". It is further informed that the counsel representing the appellants is no further a member of the Bar and is reported to have passed away.

Dismissed for non-prosecution. Liberty is, however, granted to the appellants or persons claiming interest through the appellants to seek revival of the present appeal.
