1. Learned counsel for the appellants submits that the judgment of both the Courts below are against the appellants qua the challenge to the adverse remarks in the confidential report of the respondent-plaintiff for the year 1988-89 as well as 1989-90 qua which, a relief has been given and the present appeal relates to the year 1999 and the respondent must have retired and as there was no interim order in favour of the appellants after the retirement, no action can be taken against the respondent-plaintiff as of now hence, by keeping the question of law open, the present appeal may kindly be disposed of having been not pressed any further with liberty to the appellants to revive the same in case the Department intends to seek order on merits.
2. Ordered accordingly.
3. Any civil miscellaneous application pending if any, also stands disposed of.
