The petition has been filed, inter alia, seeking a writ in the nature of certiorari quashing the order dated 06.06.2023, Annexure P-3, whereby the petitioner has been ordered to vacate the accommodation allotted to him.
2. Learned counsel for the petitioner has relied upon order 23.07.2015, Annexure P-4, passed by this Court in CWP No.3511 of 2013 Kamlesh Kumari Vs. State of Haryana and another, to contend that the impugned order is illegal and needs to be set aside.
3. A perusal of the judgment, dated 23.07.2015, shows that it has no relevance to the issue at hand. The petition was filed seeking a writ of mandamus directing the respondents to consider the petitioner for regularization. Whereas, the petitioner herein is seeking quashing of order directing him to vacate the accommodation. It was only on this undertaking that he was allowed to stay there.
4. Accordingly, when the petitioner has himself given an undertaking to vacate the premises/quarter by 25.04.2024, he cannot be permitted to file the instant petition for setting aside the vacation order dated 06.06.2023 and/or seeking extension of stay.
5. Dismissed.
