1. By this common order CWP-3339-2018 and CWP-2622-2021 are disposed of since issues involved in the captioned petitions and prayers sought are inter-connected. With the consent of parties and for the sake of brevity, facts are borrowed from CWP-3339-2018.
2. The petitioners through instant petition under Article 226/227 of Constitution of India are seeking setting aside of order dated 10.01.2018 whereby they have been repatriated to their parent department i.e. Rajasthan Rajya Vidyut Prasaran Nigam Limited (respondent No.5). HIMANSHU 2024.04.18 17:16 I attest to the accuracy and authenticity of this order/judgment.
3. Petitioner No.1 during the pendency of present petition has passed away.
4. Petitioner No.2 during the pendency of petition has been further promoted from the post of technical helper to Lineman-II. The promotion was made by Parent Department which has been accepted by respondent- Bhakra Beas Management Board. He is continuing with the respondent on the higher post i.e. Lineman-II.
5. Mr. Sachin Mittal, Advocate on being confronted with aforesaid fact expressed his inability to controvert the same.
6. The petitioner No.1 who is father of petitioner No.2 has passed away and petitioner No.2 uninterruptedly is working with Bhakra Beas Management Board. He has been further promoted and he is working on the promoted post.
7. Without commenting upon merits of the case, both the petitions with the consent of parties are hereby disposed of with a direction to respondent-Bhakra Beas Management Board to release dues of petitioner No.2, if any. The respondent shall be at liberty to pass fresh order with respect to his repatriation, if at any subsequent stage, need arises.
8. In view of the above, the petitions stand disposed of.
9. Pending misc. application(s), if any, shall also stand disposed of.
