1. The present revision petition has been filed challenging the impugned order dated 12.03.2024 (Annexure P-2) whereby the evidence of the petitioner has been closed.

2. Learned counsel for the petitioner would contend that given one effective opportunity, the petitioner would lead its entire evidence at its own risk and responsibility and that the petitioner is also willing to compensate the claimant-respondent No.1 by way of costs.

3. Mr. Vipul Sharma, Advocate has put in appearance on behalf of the contesting respondent No.1 and has filed his vakalatnama, which is taken on record. Learned counsel for respondent No.1 states that despite availing seven opportunities including the last opportunity, the evidence was not led by the petitioner and was rightly closed by order on 12.03.2024. 5. In the present case though the petitioner has been remiss in not leading its evidence and has availed seven opportunities including the last opportunity, however, in order to impart complete justice between the parties, this Court deems it appropriate to grant one effective opportunity to the petitioner to lead its evidence at its own risk and responsibility subject to payment of costs of Rs.30,000/- to be paid to the claimant-respondent No.1. The payment of costs shall be a condition precedent.

6. Disposed off accordingly. Pending applications, if any, also stand disposed off.
