1. Vide order dated 22.11.2023 notices were issued to the parties. As per the office report, appellant Nos.1 and 2 have refused to accept notices, however, affixation has been made. Accordingly, they are deemed to having been served. Appellant No.3 is stated to have died. No one has put in appearance on behalf of appellant Nos.1 and 2. None has also come forward to get themselves impleaded as legal representatives of appellant No.3.

2. Mr. B.S. Mann, Advocate for Mr. G.S. Nagra, Advocate has put in appearance on behalf of the respondent and states that the premises have since been vacated by the appellants.

3. In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

4. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
