The appellant-plaintiff is in appeal against the concurrent judgments and decrees passed against him by the Court of Sub Judge, First Class, Nabha in Civil Suit No. 133 decided on 18.11.1991 and in the judgment and decree dated 06.05.1993 passed by the Additional District Judge, Patiala in a suit for permanent injunction seeking restraint against the respondent-defendant from constructing any wall in front of the window of the house of the appellant-plaintiff.
Learned counsel appearing on behalf of the appellant- plaintiff contends that he had submitted a registered post to the appellant seeking instructions and that it has been informed that the appellant has passed away and no further instructions had been issued to him.
The present appeal is accordingly dismissed for non- prosecution with liberty to seek revival within a period of three months, if any grievance survives.
