1. Prayer in this writ petition is for quashing notice (s) dated 17.02.2023 (Annexure P-2) issued under Section 13 (2) and 18.05.2023 (Annexure P-3) issued under Section 13 (4) of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short 'SARFAESI Act').
2. Learned counsel for petitioner when faced with judgments of Hon'ble the Supreme Court in Union Bank of India v. Satyawati Tandon and others, 2010 (8) SCC 110, M/s South Indian Bank Ltd. and others v. Naveen Mathew Philip and another, 2023(2) RCR (Civil) 771 and Phoenix ARC Private Limited vs. Vishwa Bharti Vidya Mandir and others, 2022 (1) RCR (Civil) 888 seeks to withdraw this writ petition with 1 of 2 ::: Downloaded on - 18-04-2024 21:55:44 ::: Neutral Citation No:=2024:PHHC:050099-DB CWP-8296-2024 -2- liberty to petitioner to avail statutory remedy (ies) available to him in accordance with law for redressal of grievance raised in this writ petition.
