1. Learned counsel for the petitioners submits that father of petitioner No.1- namely Darshan Singh had lost his life on account of rash and negligent driving on part of respondent No.5-Darshan Singh son of Gurbax Singh, but no action is being taken by the police in this regard.

2. Learned counsel submits that although FIR No.140 dated 08.09.2023, Police Station Barnala, under Sections 304-A, 279, 427 IPC (Annexure P-1) was lodged, but the same is not being investigated properly and the police is proceeding to present a cancellation report.

3. Having heard the learned counsel for the petitioners, but without observing anything as regards the veracity of the averments made in the petition, it is directed that in case, the investigation has not been concluded till date, the Senior Superintendent of Police, concerned shall ensure that the matter is MOHAN SINGH 2024.04.15 05:32 I attest to the accuracy and integrity of this order/judgment CRM-M-17940-2024 (O&M) -2- 2024:PHHC:049801 got investigated expeditiously and fairly so that a final report is submitted thereafter at the earliest.

4. However, in case investigation already stands concluded and cancellation report has been presented, it shall be open to the petitioners to file a protest petition, in accordance with law.
