This contempt petition has been filed for willful and intentional disobedience of the order dated 25.01.2021, Annexure P-8, passed in CWP No.1608 of 2021,

Learned counsel for the respondents contends that the interim order, dated 25.01.2021, restraining initiation of departmental proceedings against the petitioner merely on the basis of second enquiry report, dated 03.09.2020, Annexure P-6, has not been violated in any manner. The memorandum of charges, dated 18.08.2022, Annexure P-12, was not issued on the basis of second enquiry report, dated 03.09.2020. Instead, charges relate to the petitioner's failure in forwarding the complaint of sexual harassment to appropriate authority, and further misconduct related thereto. Besides, the writ petition, CWP No.1608 of 2021, wherein the interim order dated 25.01.2021 was passed, has already been disposed of as infructuous.

2. Accepting the contention, rule against the respondents stands discharged, and the petition is disposed of accordingly.
