1. This order shall dispose of the above two Letters Patent Appeals wherein challenge is to the judgment dated 28.02.2018 passed in CWP No. 24998 of 2016 and judgment dated 16.05.2018 passed in CWP No. 7533-2016 whereby writ petitions filed by the respondent (s) were allowed.
2. Learned counsel for the appellants are ad idem that the issue raised in the above appeals stands finally adjudicated, in view of the judgment of Hon'ble the Supreme Court passed in a case of State of Haryana and others vs. 1 1 of 2 ::: Downloaded on - 27-04-2024 01:15:57 ::: Neutral Citation No:=2024:PHHC:049229-DB 2024:PHHC:049229-DB LPA-1416 & 1654 of 2018 (O&M) Khajjan Singh and others, passed in SLP Nos 9965-9974-2016, decided on 09.01.2024 wherein Hon'ble the Supreme has held as under:-
"Challenging the impugned Judgments, present appeals were filed before this Court, but since the issue similar in all matters, therefore they are involved tagged and taken together for hearing.
During the hearing, it has been brought to our notice that Special Leave Petition (C) Nos. 36871 of 2012; 17531 of 2014; and 25598 of 2014 filed in similar cases have been heard and dismissed by this Court vide orders dated 02.05.2014; 07.07.2014; and 12.09.2014 respectively. Further, it was also brought to our notice that while the present matters were pending, some of the respondents have been regularized and orders in this regard have been placed on the record.
After hearing learned counsel for the parties, and on perusing the orders of dismissal of the petitions passed by the coordinate benches in similar matters and also considering that some of the respondents have already been regularized by the appellants, we are not inclined to interfere with the orders impugned. The appeals are, accordingly, dismissed. However, the question of law is left open.
We further direct that the order passed by High Court shall now be complied within a period of two months from the date of communication of this order.
Pending interlocutory application, if any, is/are disposed of."
3. In view of the above, the present appeals are also disposed of, in terms of the above mentioned judgment of Hon'ble the Supreme Court of India.
4. Pending applications, if any, is/are also disposed of.
