The petition has been filed a writ in the nature of mandamus directing the respondents to consider the petitioner's case under Old Pension Scheme instead of New Pension Scheme, and also, grant second ACP grade with effect from 01.01.2021, and refix the gratuity.

2. Learned counsel for the petitioner submits that grievance raised herein is pending for appropriate decision before respondent No.2. At this stage, the petitioner will be satisfied in case respondent No.2 is directed to decide his pending representation/legal notice, dated 13.10.2023, Annexure P-1, in a specified period.

3. Notice of motion.

Mr. Sanjeev Kaushik, Additional Advocate General, Haryana, accepts notice and submits that the pending representation, dated AVIN KUMAR 2024.04.10 15:28 I attest to the accuracy and integrity of this judgment/order. 2024:PHHC:048701 CWP No.6414 of 224 [2] 13.10.2023, Annexure P-1, will be decided by respondent No.2 by passing a reasoned order in the light of judgment dated 18.11.2022, rendered by this Court in Civil Writ Petition No.35887 of 2019, titled Hawa Singh vs. State of Haryana & others, within eight weeks.

5. In view of the statement made, learned counsel for the petitioner has no objection to the petition being disposed of in terms thereof.
